THE University of Stellenbosch will oppose an application to provide essential information to beleaguered South African Rugby Union (Saru) CEO Jurie Roux in the Western Cape High Court today.

In June last year, the university filed a R37m claim against Roux for alleged financial mismanagement when he was president of the Maties Rugby Club from 2002 to 2010.

According to Roux’s lawyer, Frikkie Erasmus, they asked for supporting documentation after the issue of summons from the university last June.

The documentation has not been supplied.

Roux is being sued after auditing firm KPMG was hired by the university to undertake a forensic audit of the Matie Rugby Club’s financial dealings. The audit was completed in late 2013.

The audit report found that from 2002 to 2012, about R21m was transferred irregularly from the university’s reserve funds to the rugby club. A further R14m was spent irregularly.

"It’s strange that they had the KPMG report for so long before issuing summons," Erasmus said.

"They (Stellenbosch) eventually issued a summons in June 2015, suing for R37m if you read the detail correctly, and not R32m as has been reported. The formulation of the claim was defective and when we pointed that out to them, it took them three months to correct the errors in their statement of claim.

"In November 2015, they issued another claim and, after studying it, we asked for further documentation in terms of the rules of the court. It’s now been three months and we have still had nothing."

The delays are frustrating Roux, who according to Erasmus is anxious to have his day in court to clear his name. "Last Friday, we brought an application against the university to force them to provide the documentation we requested in December," Erasmus said.

"They have made allegations and we have asked for the supporting documents that they rely on in their claim, and they haven’t supplied them. They are now going to oppose our application.

"We are anxious to get into court for Jurie to ventilate the whole thing so that people can really see what is going on.

"We suspect that they are delaying in the hope they will get rid of Jurie before this case will be heard. They will then withdraw the action and it will die a quiet death."

University of Stellenbosch lawyers could not be reached for comment yesterday.
